Website Usage, Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.

By using our web site you agree to the terms and conditions as set out herein. In the event of any significant changes in the terms and conditions we will send notification emails to all active users and Galloways reserves the right to change or update these terms and conditions from time to time. We suggest you visit these pages frequently as you are responsible for acknowledging any updates of these terms and conditions.

Definitions

“Company”, “Steve Galloway” “VoiceMS”, “Voice Over Management Services”, ComStat.uk”,”Galloways” “GALLOWAYS ” (“us”, “we”, “our” and “ours”) means the operator(s) of this site.

“Customer(s)”, “Voice Seeker(s)”, or “Client(s)” means any person who submits or publishes a requirement for services on the Website for an “Artist” to supply.

“Artist(s)”, “Talent”or “Voiceover Artist” means authorised individuals recording scripts on behalf of Galloways.

“Website” means the website Galloways and all the pages and content contained therein.

“User(s)” means any registered person of the Website.

Overview of the Website

VoiceMS.com is a website dedicated to connecting customers to voice over services.

Liability of Provided Voice Content

Client(s) are responsible for checking any copy or scripts for mistakes and legal issues prior to submission to Galloways and Galloways accept no liability for these issues.

In the event that any content or script(s) recorded by Galloways is unusable due to artist error please contact us immediately for a resolution. This includes the quality of the recording and file delivery. We will make every effort in the first instance to correct or re-record your project without further charges. If we cannot resolve your issue we are responsible only for the costs incurred that were imposed by our site. We do not accept liability for any other loss or losses incurred.

Voice and Content License

All licences for voices, music and/or any other content purchased from Galloways are for a period of one calendar year for the project, station or territory detailed in the initial order. We reserve the right to make further charges at any time should we find this period has been exceeded, or the content or any element of it, are found to be used in any way that contravene the license period.

Any audio recorded for clients will be kept secure by us for a period of 30 days.

Payment Terms for Clients

As a client seeking a voice for projects, payment is accepted via PayPal to ensure a fast efficient service. New customers will pay 75% of the quoted price before execution of work. When the customer accepts a finished sample of the work, usually about 75% of the content, the remaining 25% of the balance will fall due for payment. On receipt of the final payment, Galloways will release the completed project.

Returning customers can request a 30 day account by contacting us directly. We consider all applications on an individual basis.

We will notify you when script has been digitally produced and is ready for delivery.

Content Warranties & Liabilities

You agree that all material posted not limited to but including, messages, text, files, images, photos, video, sounds, or any other content posted on, transmitted through, or linked from Galloways, are the sole responsibility of the person or user from whom such content originated. Each user is entirely responsible for all content that they post, email or otherwise make available through the website.

Galloways shall not be liable for any loss, injury or damage of whatever kind caused in whole or in part by use of the web site or the information provided therein, or by any failure, delay, interruption or as a result of the use of any content posted, emailed or otherwise made available via Galloways, or by Galloways’ failure to perform any of its obligations under these Terms.

Any links to content from other companies and websites are completely independent of Galloways. Linking to any other websites through our web site is done so entirely at your own risk. Under no circumstances will Galloways be liable in any way for any content or for any loss or damage of any kind incurred. Galloways makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such website.

You acknowledge that Galloways reserves the right to modify or discontinue the website (or any part thereof) with or without notice at any time. Galloways shall not be liable to you or to any third party for any modification, suspension or discontinuance of any services.

Intellectual Property

Other than in relation to links to third party websites, Galloways owns all the intellectual property rights relating to the site, including the designs, text, database, graphics and layouts. You are expressly prohibited from reproducing, copying, editing, transmitting, uploading or incorporating into any other materials of the web site; and removing, modifying, altering or using any registered or unregistered marks/logos owned by Galloways and/or any companies promoted within, and from doing anything which may be seen as taking unfair advantage of the reputation and goodwill of the web site or could be considered an infringement of any of the intellectual property rights owned and/or licensed to the Website.

Term and Termination

These Terms will remain in full force and effect while you are a User of the Website. Galloways may, at any time and for any reason, terminate these Terms with you and deny you access to the Website. In the event of termination of these Terms for any reason, you must not attempt to use the Website. The above Terms shall survive termination for any reason, and shall be valid and enforceable against you.
